Admissibility of Non-Use of a Seat Belt in Texas Car Accident Cases


The Texas Supreme Court has granted a review of a case concerning the admissibility of the non-use of seat belts in a trial of an auto accident case. The case involved an accident in which the driver and passengers were seriously injured a collision with a semi-truck. The driver and passengers were not wearing seat belts. The trial court rule that the plaintiffs' non-use of the seat belts was admissible in evidence. Not surprisingly, the injured plaintiffs lost the case when the jury found that the plaintiffs' negligence for not wearing safety belts overcame the negligence of the truck driver in causing the accident. On appeal, the El Paso Court of Appeals reversed the trial court's ruling and held that the Plaintiffs' non-use of a seat belt should not have been admitted into the trial. Further appeal was taken to the Texas Supreme Court, where the attorneys have just finished filing briefs. Given the history of the law in this area, Texas personal injury lawyers, both on the plaintiff's side and the defense, eagerly await the Court's decision.

In 1985, Texas passed a statute mandating the use of sea tbelts while operating or occupying an automobile. See Texas Transportation Code, Section 545.413. Prior to the passage of that statute, the common law in Texas was that the non-use of a seat belt is not admissible in a civil trial for personal injuries resulting from a car accident. The rational behind the common law was that the non-use of a seat belt is not relevant to the cause of the accident. In other words, a car accident is caused by the negligent operation of a motor vehicle and not by the non-use of seat belts.

When the seat belt statute was first passed, the Texas legislature tipped their hat to the common law rule. The statute actually had an express provision that stated the use or non-use of a seat belt was not admissible in a civil trial. But in 2003, with the passage of House Bill 4, that section was repealed from the statute. The Texas Supreme Court is now faced with deciding what legal effect did the repeal of that section have on the long-standing common law. Does the repeal of that section mean that the non-use seat belts is now admissible or does it mean that the issue is left for the Texas courts and common law to decide?

If the legislature intended for seat belt evidence to be admissible in a civil trial, then why did not it just equal the sentence to expressly provide that the non-use of a seat belt be admissible rather than just remain silent on the issue? It will also be interesting to see how the Court deals with the difference between negligence that contributes to the cause of the car accident and negligence that contributes to the cause of the injury . Texas common law has held that only evidence of negligence that causes or contributes to the accident is relevant and admissible. Will the Texas Supreme Court adhering to this long-established common law or will it open the door to evidence relating to the circumstances that may have contributed to the injury, but not to the accident? If the Court entertains the proposal of over-ruling established common law, it will create a difficult and demanding situation in which every personal injury caused by someone else's negligence will be scrutinized for conduct that had no causal effect on the accident.

Among its many gifts were 100 kg of gold to cover the dome and some beautiful marble. We marvelled at the inverted lotus, the pinnacles, columns, oriel window and fluted domes, all gleaming and finely carved, and time just seemed to fly.

The upper floor welcomed us with a glinting hall of mirrors and square atrium which allowed everyone to glance at the bejewelled canopy, protecting the Holy Book on the floor below. The reading echoed like a heavenly whisper and all around were semi-precious stones, coloured glass, embossed copper, holy verses from the religious scriptures, and different kinds of floral and animal patterns embellishing every space, wall, ceiling and archway. They included a few human figures. Some say it’s a blend of Hindu and Mughal designs, while others call it uniquely Sikh. Either way, the astounding mural art is largely the work of unknown artists and a poignant testimony to their faith.

There is little room for movement inside the inner sanctum. So, after a last look at the view from the terrace, we returned to our earthbound world where we received a small helping of Karah Parsad, the sanctified sweet pudding. We reflected upon the simple practice of good deeds and kind words, truth, faith and equality, and the vision of heaven as ‘merging with the Divine Spirit, like a spark in the fire.’ As the sun reached its highest point, the temple lit up the whole scene and reflections shimmered like gold in the lake. Imbued with 500 years of Sikh heritage, the Golden Temple is a living and mystical place to this day.

Hotel Nacional De Cuba – A Classic With a Thousand Stories


Maybe you, interested in the values ​​Havana has to offer as a destination in the Caribbean, already know or have read about the insignia institution of all Cuba hotels; The Hotel Nacional de Cuba. I will begin by telling you that the Hotel Nacional could today stand in a totally different place … Its actual location is in fact what most identifies this hotel within the urban map of Havana. The hotel is located in the coastal outgoing land of Punta Brava, in the highest position of the Taganana hill, almost at the extreme of the Caleta de San Lázaro. This location use to be a regular place for pirate ship territories during the XVII and XVIII centuries, reason why the Spanish metropolis chose the position to establish the famous Canon Battery of Santa Clara, of which some relics can still be found in the hotel gardens. But as mentioned before it could have been built in another location.

It was the second decade of the past century and Havana was in need of a luxurious hotel. It should be noted that by this time, Cuba already received some 60 thousand tourists a year. The President of The Republic was Gerardo Machado and in his Cabinet of Ministers outstands a man that in time and with his endeavors in charge of the Public Works during the governance of Gerardo Machado, would gain himself the name of "The Intrepid". We are referring to Carlos Miguel de Céspedes. It was this man who most boosted the idea of ​​building the Hotel Nacional de Cuba.

An immediate reaction isose from several interested investors. The American Casa Morgan pressured the government of Machado to allow them to build and operate this hotel. A delegation of American bankers and entrepreneurs was in Havana in these days headed by Mr. Brownson, president of the Purdy & Henderson construction company. Its members had interviews with Mr. Céspedes and manifested that if the government were to yield the grounds of the ancient Havana Jail, the company would build a magnificent hotel of 500 rooms. It was the intention of these men to build the hotel more to what was the center of Havana, just by the entrance of the Havana Bay, so that the future hotel would face the lighthouse of the Castillo del Morro.

Carlos Miguel told the Americans that this location could not be used for the project since the government had already designed these grounds to the construction of the Palace of Justice, which plans had already been delivered by the Foresturers famous French planner; Céspedes had a better place in mind.habana-hotel-nacional.jpg

Mr. Brownson reacted in fury and faced the Minister. Out of control, he told him that he would accept no other spot than the one he had requested. When Céspedes realized he was being pressured he called the construction company president a "zoquete" (blockhead) and told him it was impossible for them to do any business at all. When the other members of the American delegation noticed that the Minister was not someone that could be "blackmailed", they intervened managing to calm both men and, a while later, they all agreed to visit the location that the Cuban representative had in mind and was willing to offer.

A while later Céspedes would tell the story to the press in the following words:

"When Mr. Browson got to the location, there, to the ancient Canon Battery of Santa Clara, he was speechless.

The contract for the construction of the hotel was even auctioned, at least apparently, and was won by Purdy & Henderson who also represented the interests of the Hotel Plaza in New York and the Morgan House. 3 million pesos would be invested in the hotel.

Another proof of intransigence was presented by Carlos Miguel when he proposed that in the contract it should be very clear that only the Cuban Flag was to flutter in the property. This determination would provoke yet another incident. These were times when the American flag would wave in the official buildings by the Cuban flag.

The day of the signature of the contract gathered what was the high society of the time in Havana with president Machado. While the contract was read Céspedes noted that the case he had asked for had been omitted and, to President Machado's surprise, Carlos Miguel tore the contract in pieces demanding a new contract where it would be clear that only the Cuban Flag would flutter by the hotel .

This story, related to the beginnings of the installation, is only one of many that the hotel treasures. Las Vegas Job Openings Have Higher Pay


Anyone able to snag a Las Vegas job opening is likely to get paid more than workers in most other cities. A recent report from Forbes used data from PayScale to rank the income of workers in the 100 largest metro areas throughout the country. The Las Vegas area was ranked 15th, with the city’s median pay increasing 13.9 percent from $51,500 in 2005 to $58,700 in 2009.

El Paso, Texas, was ranked first, as the city’s median income increased by 19.4 percent to $49,100.

On the other end of the scale, Harrisburg, Pa., was ranked last, with the city’s median pay decreasing by.74 percent to $50,600.

Other cities close to Las Vegas that have been having economic trouble also placed well on the list. Phoenix was ranked 10th, with the city’s median pay increasing by 15 percent to $61,100, while Bakersfield, Calif., was ranked second, as the city’s median income increased by 18.5 percent to $60,900.

The report noted that in some cities, high unemployment may actually correlate to an increase in median pay.

During November, the Las Vegas-Paradise area saw its unemployment rate decrease from 13 percent to 12.1 percent, following a decrease from 13.9 percent during October. Despite the decrease, the area’s current rate is still higher than the national unemployment rate of 10 percent.

The Las Vegas area had a total non-farm employment of 843,100 workers during November, according to the U.S. Department of Labor Bureau of Labor Statistics. This is down from 851,900 workers during October and a 6.7 percent decrease from last year.
